If an applicant is denied, the SSA sends a second warning. The applicant is allowed to request a hearing before the Administrative Law Judge (ALJ) within sixty-five working days. Similar to hearings on disability issues, this hearing can be requested. The hearing can take place in person, over the telephone or via videoconference. The applicant, or their representative, can bring witnesses to testify regarding the issues and the circumstances that led to the denial. An ALJ can also arrange for expert testimony in support of the case. If the applicant loses, then the ALJ will write to the applicant stating the reasons. This hearing can take up to several months.

A disability review can take from three to seven year. It may be approved, denied, or remanded for additional information. If an individual is able or able, the SSA may initiate a disability evaluation.

A Data-Related Agreement can be a legal document that must be approved by SDI Team before being executed. These agreements should be submitted through Cognito Formulas. The SDI Team can review any Data-Related Agreement within 30 days. They may also request additional information, such as security controls or a SOC 2 Type II Audit. They can also ask for additional questions, such as data migration questions.
Once a Data-Related Agreement was submitted, the SDI Team would review the documentation and propose contracts. The Agreement is subjected to the same privacy/security policies as other forms submitted through Cognito Forms.
